SHORT-TERM RENTAL AGREEMENT & BOOKING TERMS
This Short-Term Rental Agreement ("Agreement") is entered into between Majestic Stays ("Host", "we", "us", "our") and the guest named below ("Guest", "you", "your") in relation to a short-term stay at one of the properties described below, located in Christchurch, New Zealand. By completing payment, ticking the acceptance checkbox at checkout, or signing this Agreement, the Guest agrees to be bound by all terms set out below.
1. Booking Details
The booked Guest must be 18 years or older and will be the lead signatory responsible for this Agreement, the conduct of all occupants and visitors, and any damage arising during the stay, regardless of who else is present at the property.
2. Properties
6 bedroom house- maximum 12 person occupancy
1 bedroom townhouse - 2-3 person occupancy. Sofa bed is ideal for a child only.
Exceeding the maximum occupancy stated above without the Host's prior written consent is a material breach of this Agreement and may result in immediate termination of the stay without refund and forfeiture of any security deposit.
3. Payment Terms
A non-refundable booking fee and/or deposit (as shown at checkout) is charged at the time of booking to confirm the reservation.
The remaining balance is automatically charged to the card provided, according to the payment schedule shown at checkout (typically 7–14 days prior to check-in).
If a scheduled payment fails, the Host will attempt to contact the Guest. If payment is not resolved within 48 hours, the Host reserves the right to cancel the booking and release the dates.
All prices are in New Zealand Dollars (NZD) and are inclusive of GST.
4. Security / Damage Deposit
A refundable security deposit may be held via credit card pre-authorisation prior to check-in, as specified at the time of booking.
The deposit will be released in full within 3–7 business days after check-out, provided the property is left undamaged, in a clean and tidy condition, and all terms of this Agreement have been met.
The Host may deduct from the deposit (or charge the Guest's card separately if the deposit is insufficient) the reasonable cost of: repairing damage, replacing missing or broken items, excessive cleaning, removal of rubbish, or any fines or charges arising from breach of house rules (including unauthorised parties, smoking indoors, or exceeding maximum occupancy).
Where damage or breach costs exceed the deposit held, the Guest remains liable for the full cost and agrees the Host may charge this to the payment method on file.
5. Cancellation & Refund Policy
Cancellations made more than 14 days before check-in: full refund.
Cancellations made up to 7 days before check-in: 50% refund of amounts paid.
The Host recommends the Guest obtain their own travel insurance to cover cancellation, illness, or travel disruption.
In the rare event the Host must cancel a confirmed booking (e.g. property damage, unforeseen unavailability), the Guest will receive a full refund of all amounts paid, and the Host's liability is limited to that refund.
6. House Rules
Maximum occupancy stated in Section 2 must not be exceeded at any time, including day visitors, without prior written approval from the Host.
No parties, events, or functions of any kind are permitted at either property. Bookings found to be associated with a party or event may be terminated immediately without refund.
Quiet hours apply from 10:00pm to 7:00am. Noise that disturbs neighbours at any time may result in a warning and, if repeated, termination of the stay without refund.
Smoking or vaping is strictly prohibited inside either property. A cleaning/odour-removal fee of no less than NZD $500 will be charged if evidence of indoor smoking is found. Smoking is only allowed in designated outdoor areas.
Pets are not permitted unless expressly approved in writing by the Host prior to arrival.
Parking is limited to the on-site spaces allocated to each property (3 cars at the 6 bedroom house). No parking is available at the townhouse. Vehicles must not block neighbouring properties or driveways.
The Guest agrees to treat the property, furnishings, and all equipment (including the cinema, games room, and kitchen appliances) with reasonable care, and to use them only for their intended purpose.
The Guest must report any damage, breakage, or malfunction to the Host as soon as reasonably possible.
The property must be left in a reasonably clean and tidy condition at check-out. Excessive mess or rubbish left behind may incur an additional cleaning charge.
7. Access, Check-in & Check-out
Check-in and check-out times will be confirmed at booking. Early check-in or late check-out is subject to availability and may incur an additional charge.
Self-check-in instructions (door codes/access details) will be sent to the Guest closer to arrival, once payment has been received in full and this Agreement has been accepted or signed.
The Host or an authorised representative may enter the property with reasonable notice (or without notice in an emergency) to carry out any inspections, maintenance, or to address a breach of this Agreement.
8. Liability & Guest Responsibility
The Guest and all occupants use the property, including the cinema room, games room, and all equipment and furnishings, at their own risk.
The Host is not liable for any injury, loss, or damage to persons or property arising from the Guest's stay.
The Guest is responsible for the behaviour of all members of their party and any visitors they invite to the property during the stay.
9. Acceptance
By ticking the acceptance box at checkout, making payment, or signing below, the Guest confirms they have read, understood, and agree to be bound by this Agreement, including all payment terms, the security deposit terms, and the house rules set out above, on behalf of themselves and all members of their party.
